Estate plans are designed to take care of assets, not necessarily family relationships. 30% of wealth transitions are successful, which means 70% are not. Based on our widely recognized research, 60% of failed transactions is due to trust and communication issues, 25% is lack of heir preparedness and 10% is values and mission issues. Yet, most families spend the majority of their time on governance, tax planning, and wealth preservation. The families that take proactive steps and invest in programs to support family unity are dramatically more successful in maintaining a family legacy across generations.

KEYNOTE:  THE IMPORTANCE OF MODERN ASSET PROTECTION PLANNING

Discussion of the importance of asset protection and how certain individuals and professionals are vulnerable to potential creditor claims, especially in the litigious society we live in. There will be a detailed analysis of how various asset protection techniques can help shield assets against future creditors but not necessarily be effective against existing and anticipated future creditors. Other topics include how certain assets are exempt from particular creditor claims, and how certain irrevocable trusts can be used as an effective asset planning device to shield assets from creditors. Also, the elements of domestic and foreign asset protection trusts will be compared.
